Court dismisses lawsuit against tobacco companies


R.J. Reynolds Tobacco Co. on Tuesday said a Federal District Court in Massachusetts dismissed a lawsuit brought against the company and other tobacco manufacturers by United Seniors Association Inc.

United Seniors was seeking to recover medical expense reimbursements made by Medicare since August 4, 1999, to treat Medicare recipients for illnesses attributable to cigarette smoking.

R.J. Reynolds, an indirect subsidiary of Reynolds American Inc., said the decision marks the fourth time a federal court has dismissed claims against the tobacco industry under the so-called Medicare as a Secondary Payer law.
