SMOKING BAN AXED
Commonwealth Court ruled Tuesday that Allegheny County officials
do not have the authority to enact a smoking ban.
"That's what we've said from the beginning," said John
Petrolias, owner of the Smithfield Cafe on Smithfield Street,
Pittsburgh. "They did not have this authority."
Shortly after Allegheny County Council approved the smoking ban
last year, Petrolias and James Mitchell, owner of Mitchell's
Restaurant on Ross Street, Pittsburgh, challenged the ordinance
in a lawsuit funded by R.J. Reynolds Tobacco Co.
