SMOKING NEAR CHILDREN LIGHTS UP A NEW DEBATE

They've banned smoking from offices and restaurants. Now, the
next frontier is cars and homes.
States are starting to make laws prohibiting people from smoking
around children, such as in a car with a child who is young
enough to require a car seat, or in homes with foster kids
because they are in state custody.
Texas, Vermont, Washington, Arkansas and Louisiana are making
these laws. Courts are ordering smoke-free environments in
custody and visitation disputes.
Pensacola resident Mark Milstead is a smoker, but he doesn't
smoke in his car or inside his home, he said. He has a
4-year-old daughter, Brianna.
"It's bad for your health, so I wouldn't do that around my
child," said Milstead, 25. "I didn't agree with banning it from
restaurants. But as far as banning smoking around kids -- I
agree with that."
In Florida, the Clean Indoor Air Act has a pre-emption clause in
which the state's smoking law supersedes any city or county
ordinance.
